SAN DIEGO -- Miguel Montero and the Arizona Diamondbacks are moving up. Montero hit a two-run homer in the sixth inning, lifting the Diamondbacks past the Padres 3-1 on Saturday night and out of last place in the NL West. The Diamondbacks started the season 8-22. With the win, they moved percentage points ahead of the Padres in the standings at 35-48. "I guess its good to get out of last place," Montero said. "I hope we continue like that and see where we are going." Montero struck out against Eric Stults in his first at-bat but connected for his 11th home run next time up. The homer came on a changeup, something he had missed on in his earlier at-bat. When Stults tried to fool him later, Montero was ready. "I put a good swing on that one," he said. "It was middle, middle-in, and sometimes those are pulled foul. But it stayed fair so I guess I stayed inside the ball very good." Josh Collmenter (6-5) pitched 5 1-3 innings, giving up one run and five hits as Arizona won consecutive games for the first time since June 7-8 against Atlanta. Addison Reed worked the ninth inning for his 19th save in 22 chances. He was the fourth Arizona reliever, a group which didnt allow a hit or run over the final 3 2-3 innings. "I kind of wished I would have gone deeper in the game," Collmenter said. "But the bullpen did a great job tonight." Diamondbacks manager Kirk Gibson saluted his bullpen as well, and noted it was a typical game at Petco Park. "Its hard to score in this park and we played just well enough to win," he said. It was difficult for Padres manager Bud Black to accept the loss, the Padres third straight defeat. "One bad pitch," Black said of Stults offering to Montero. "Tried to get a changeup down and away and he just missed his spot." Stults (2-11) became the majors leader in losses, with an NL-high 5.36 ERA. He also went 5 1-3 innings and yielded three runs -- two earned -- while giving up just three hits. Stults walked three for the second straight game and stuck out two in losing his career-high sixth consecutive start. Paul Goldschmidt was aboard for Monteros homer, after walking and reaching second on a botched double-play attempt. Martin Prado grounded to Chase Headley, but his throw to second baseman Alexi Amarista was high, with Goldschmidt being safe. Amarista retired Prado at first, a play which was challenged by Gibson but upheld. "I just got underneath it a little bit and it sailed," Headley said. "Lexi did a great job to make a play and get an out still." When Stults hit Cody Ross right after Montero homered, he was pulled in favour of Alex Torres. He prevented further damage by getting Gerardo Parra and Collmenter on grounders to first base. Matt Stites relieved Collmenter in the sixth inning, and walked Cameron Maybin to load the bases with two outs. But Rene Rivera, who had two hits, struck out. The Diamondbacks tied the score in the third inning, thanks in part to an error by Rivera. Ender Inciarte singled and stole second, advancing to third when Riveras throw was off line. Inciarte scored on Prados one-out sacrifice fly. Tommy Medica drove in the games first run with a sacrifice fly in the first inning. Chris Denorfia opened the inning with a double and took third on Seth Smiths grounder to first base. The Padres threatened in the fifth inning when Rivera led off with a single and moved to second base on a sacrifice bunt by Everth Cabrera. But Amarista flied out and Stults struck out. Adrian Peterson has been suspended indefinitely after the team placed him on the Commissioners Exemption List. Peterson will not be allowed around the team in any capacity until the legal proceedings have been resolved. This is a reversal of the teams previous decision, where it announced Peterson was being reactivated for this Sundays game against the New Orleans Saints. Section 17.14(a) of the NFL Constitution and Bylaws provides that the "Exemption list is a special player status available to clubs only in unusual circumstances". The same Policy also indicates that "any request must be sent to the Commissioner", should "include complete facts and reasons" to support the request and that "only the Commissioner has the authority to place a player on the Exemption List". Getting the league to put a player on this list is a big deal. Indeed, a team needs to show "unusual circumstances", which at law means a high standard. This can be very tough to meet. This makes sense. If the league could impose this type of sweeping discipline on a player at will, it would likely do so more often. By requiring "unusual circumstances", the power of the league is appropriately narrowed. The Exemption List has been used in the past by the NFL. After serving his Bounty Gate suspension, Jonathan Vilma wasnt ready to return and was able to get himself on the Exemption List. As well, Tampa Bay Buccaneers running back Jeff Demps was placed on the list when he wanted to pursue a track career. Michael Vick was also subject to this exemption after being released from prison and signing with the Eagles. In each of these cases, the assumption is that the player consented to the exemption, or frankly sought it out. The case of Peterson, though, is a bit different.dddddddddddd As per the NFL CBA, the Vikings could only suspend or deactivate Peterson for a maximum of four games. Apart from that, it had the option of cutting Peterson or playing him. The NFL also could have suspended Peterson under its Personal Conduct Policy (which incidentally now incorporates the new domestic violence and assault guidelines), but that suspension would have likely been limited in duration and would have expired before the legal case was resolved. If the NFL attempted to suspend Peterson for the entire season, it would have been hit with a grievance by the NFLPA. So the league and Vikings needed to find a way to suspend Peterson indefinitely without risking a grievance or even a potential lawsuit. And thats when it turned to the Commissioners Exemption List. However, given the high standard that had to be met in order to unilaterally place a player on the Exemption List, it would have made good sense to secure Petersons consent to the indefinite suspension. Without it, the NFL would have once again risked a grievance being filed by the NFLPA resulting in the story continuing to loom over the league. How do you gain consent in a case like this? Money. For this reason, it was not a surprise to learn this morning that Peterson was being suspended indefinitely with pay. This means that Peterson consented to the suspension. The NFLPA confirmed this when it said that "Adrian Peterson made a decision to take a voluntary leave with pay to take care of his personal and legal issues." So Peterson is now suspended until the legal proceedings are resolved. With a likely Court date in early 2015, it seems probable that Peterson will not return this season. "SOME THINGS JUST WONT RETIRE" The veteran quarterback tried it for a few months, and retirement didnt suit him. Especially with his balky left knee feeling healthy again for the first time in a while. "I didnt want to turn 50, look back, and be that guy that said, What if I just called somebody?" Garrard said Thursday after his first practice back with the Jets. "Im glad I did." The 35-year-old Garrard was removed from the reserve-retired list and placed on the exempt list, meaning he is eligible to practice and attend meetings. With Mark Sanchez out for the season with a shoulder injury, Garrard gives the Jets a veteran backup for rookie Geno Smith. Garrard, who signed with New York in March before leaving because of knee trouble in May, will be on the exempt list for two games. The team will need to make a decision whether to activate him by Oct. 21. During those days, Garrard felt, well, officially retired from football. "I was still having some aches and pains, and my knee was still swollen," he said. "I just continued to relax and rest and not do too much." After gaining some weight from the inactivity, Garrard decided to try to get active again. Garrards wife Mary was part of a flag football team, and he was constantly running and making cuts while catching passes from her -- and the knee felt fine. Thats when the comeback plan kicked in. "Im 35, so Im not so old that it doesnt make any sense," he said. "I know I have some years left in me." He hasnt played in a regular-season game in the NFL since 2010 because of injuries. But his signing leaves the status of Brady Quinn uncertain. Quinn is currently listed as the teams No. 3 quarterback, and he has been unable to surpass the inexperienced Matt Simms on the depth chart. He has been inactive for four games this season. Garrard has thrown for 16,003 yards in his career, with 89 touchdowns and 54 interceptions. "We have a plan," offensive co-ordinator Marty Mornhinweg said.
