NOBLESVILLE, Ind. -- Indianapolis Colts owner Jim Irsay wont have to appear in court Thursday for an initial hearing on drug-related charges he faces. Irsays attorneys filed a motion Wednesday waiving his appearance on misdemeanour charges of driving while intoxicated and driving with a Schedule I or II controlled substance in his body. Myra Borshoff Cook, a spokeswoman for Irsay, had no immediate comment. The charges against Irsay carry maximum penalties of 60 days in jail and $500 fines for each count. Hamilton County court documents say Irsay was driving under the influence of prescription painkillers. Irsay, 54, was arrested near his home in suburban Carmel on March 16 after police say he was spotted driving slowly, stopping in the roadway and failing to use a turn signal. Police said he failed field sobriety tests and an officer believed him to be intoxicated, but not on alcohol. Various prescription drugs were found in his vehicle. Attorney Steven Stoesz, who often handles similar cases, said waivers are not uncommon in misdemeanour cases where a defendant has bonded out of jail and retained an attorney. "The purpose of an initial hearing is for the court to advise a person of the charges they are facing, of their constitutional rights and to set future court dates," Stoesz told The Indianapolis Star (http://indy.st/1ngp2n8). Retaining an attorney essentially lets the court know you are aware of your rights and the charges against you, he said. The next hearing on Irsays case will likely come within 30 days, but Stoesz said that meeting may involve only lawyers and the judge and Irsay may not attend. Joerger met with Timberwolves president of basketball operations Flip Saunders about Minnesotas coaching vacancy on Thursday and is scheduled to meet with owner Glen Taylor at some point this weekend, a person with knowledge of the process told The Associated Press. If Joerger makes a good impression with Taylor and the Timberwolves and Grizzlies can come to some sort of agreement on compensation for to get him out of his contract, all signs point to Joerger replacing the retired Rick Adelman back in his home state. The 40-year-old Joerger grew up in Staples, about 150 miles northeast of Minneapolis, and played collegiately at Division-II Minnesota State, Moorhead. Joerger went 50-32 in his first season as an NBA head coach with the Grizzlies, leading an injury-plagued team back from a 10-15 start to the seventh seed in the Western Conference playoff field. After the Grizzlies lost to Oklahoma City in seven games in the first round, owner Robert Pera made the surprising decision to fire two of his top executives, including the one most responsible for elevating Joerger from assistant to replace Lionel Hollins. The three-time All-Star can opt out of his contract after next season, which has raised the possibility of him being traded at some point this summer. Joerger deftly navigated sticky situations in Memphis last season, especially during the teams poor start. He also showed some flexibility to change a few his offensive philosophies and return the grind-it-out style that the physical Grizzlies preferred, and the team took off.
